Marshall Islands

The Marshall Islands has dedicated counterterrorism legislation from 2002. There is no carve-out for the exercise of fundamental human rights. The counterterrorism law was amended in 2020 to strengthen the prevention of terrorist financing.

Mauritania

Mauritania has dedicated and detailed counterterrorism legislation but existing penal law is not considered comprehensive by the United Nations. In early 2022, the UN Office on Drugs and Crime (UNODC) conducted a workshop to assist Mauritanian authorities to enhance the national legal framework on counterterrorism and ensure its compliance with international legal norms. There is no carve-out for the exercise of fundamental human rights. Under Mauritanian law, the death penalty is imposable for terrorist offences that involve homicide.

Mexico

Mexico has detailed counterterrorism provisions in its federal criminal code covering both domestic and international terrorism. There is no carve-out for the exercise of fundamental human rights.

Micronesia

The Parliament of Micronesia proposed in 2005 and again in 2008, but did not adopt, detailed counterterrorism provisions in its criminal code. It is thus one of very few countries that does not explicitly define and proscribe acts of terrorism in its domestic law. The 2008 proposal would have contained a carve-out for both situations of armed conflict and for the exercise of certain fundamental human rights.

Moldova

Moldova has detailed counterterrorism legislation in its criminal code. There is no carve-out for the exercise of fundamental human rights and the breadth of the law has been criticised by the Council of Europe's Venice Commission

Monaco

Monaco has counterterrorism provisions in its Criminal Code as well as distinct legislation focusing on terrorist financing. There is no carve-out for the exercise of fundamental human rights.

Mongolia

Mongolia has detailed counterterrorism provisions in its domestic law, including limited offences set forth in its Criminal Code for which the death penalty may be imposed. Mongolia's 2004 Law on Combating Terrorism was revised as the Law on Counter-Terrorism and Proliferation in 2019. There is no carve-out for the exercise of fundamental human rights.

Montenegro has detailed counterterrorism provisions in its Criminal Code. Terrorism is also punishable as a war crime in a situation of armed conflict.
